A quick definition of false evidence:

False evidence is when someone presents information that is not true in a legal setting, such as in a trial or affidavit. This can include testimony that is not based on direct knowledge or is intentionally misleading. It is important to have truthful evidence in order to make fair and just decisions in legal cases.

A more thorough explanation:

False evidence refers to evidence that is not true or accurate. It can include false testimony given by a witness under oath or affirmation, or any other type of evidence that is intentionally or unintentionally misleading.

  • Dropsy testimony: This is a slang term used to describe a police officer's false testimony that a suspect dropped an illegal substance that was then confiscated by the police and used as probable cause for arresting the suspect. This type of false evidence is sometimes given when an arrest has been made without probable cause, as when illegal substances have been found through an improper search.
  • Cumulative testimony: This refers to identical or similar testimony by more than one witness, offered by a party to impress the jury with the apparent weight of proof on that party's side. The trial court typically limits cumulative testimony.
  • False testimony: This refers to testimony that is untrue. It is broader than perjury, which has a state-of-mind element. Unlike perjury, false testimony does not denote a crime.

These examples illustrate how false evidence can be used to manipulate the legal system and influence the outcome of a trial. It is important for witnesses and other parties involved in legal proceedings to be truthful and provide accurate evidence to ensure a fair and just outcome.

You'll forever have those days where shit ain't getting done. Just a matter of how you handle them. (IE using Chatgpt to draft a motion for leave like meeeee)

Nah, I don't use it to do my case law. Just the actual motion drafting.
For example, I was trying to get the right language in a Motion for Sanctions (tl;dr slip and fall case, defense counsel played nothing but games – IE never sending records despite it being mandatory to trcp, producing never before seen records DURING A DEPO) and just talked to ChatGPT about his behavior to provide background to help with the drafting for the procedural paragraph.
@NosyBeagle: just makes me think of vanillamace
