The plaintiff sued Jumpking, Inc. for defective design of a trampoline and negligence in failing to warn of the danger in using it after he was severely injured while using the trampoline. The district court granted the defendant's motion for summary judgment, which was affirmed on appeal. The court found no errors at law and concluded that the plaintiff failed to generate a genuine issue of fact to exempt the trampoline from the alternative-design requirement of section 2(b) and rejected the plaintiff's design-defect claim under that section. The passage notes that in cases involving common and widely distributed products, courts have generally deferred to legislatures and administrative agencies to consider the desirability of commercial distribution of dangerous products. The plaintiff's claim of inadequate warnings is not addressed.
