The Indian Health Service provided diagnostic and treatment services to handicapped Indian children in the Southwest through the Indian Children's Program. The Service decided to discontinue the Program in 1985 and allocate its resources to a nationwide effort. Handicapped Indian children challenged the decision in court, and the District Court ordered the Service to reinstate the Program. The Court of Appeals upheld the decision, but the Supreme Court ruled that the decision to discontinue the Program was not subject to judicial review under the Administrative Procedure Act. The Service's decision fell within its statutory mandate, and the appropriations Acts for the relevant period did not mention the Program. The respondents' claim that the Service's termination of the Program violated their rights under the Fifth Amendment's Due Process Clause will be addressed on remand.
