In the 1986 case Car Carriers, Inc. v. Car Carriers, a transport company working with Ford, accused Ford and another carrier, Nu-Car, of breaking antitrust and state laws. They claimed that Ford misled them with false promises of increased business and rates, only to terminate their contracts and prevent growth. Car Carriers also alleged that Ford colluded with Nu-Car to submit lowball bids in a predatory strategy.

After an initial lawsuit filed in 1982 was dismissed by the district court, Car Carriers filed a second suit in 1983, presenting new federal claims and again asserting state law claims. However, the district court dismissed this second lawsuit based on res judicata, reasoning that it involved the same facts as the first case. The Court of Appeals agreed and upheld the dismissal.

The court utilized a test based on the "identity of claims" and found that the second suit stemmed from the same contractual relationship and alleged injuries as the first. The fact that different legal theories or injuries were presented did not matter, since the main focus was on the connection between the claims. The ruling reinforced the principles of res judicata, claim preclusion, and federalism, emphasizing the need for finality and efficiency in litigation. The court upheld the district court's decision that a current lawsuit against Ford and Nu-Car was barred by res judicata due to a previous lawsuit accusing them of conspiring in violation of the Sherman Act, which lacked the necessary harm to be compensated and was dismissed with prejudice. The current lawsuit, consisting of twenty-four counts, including RICO violations, a violation of the Interstate Commerce Act, and violations of Illinois law, was dismissed without prejudice as the federal claims were barred by res judicata. The 1982 Complaint alleged that Car Carriers accused Ford of engaging in anti-competitive behavior by employing a method to eliminate target carriers, which involved promising increased traffic and agreement with increased tariff rates, but then preventing them from obtaining the necessary rate increases for profitable operations. Car Carriers claimed that its demise followed this pattern.
