Facts
- The Bureau of Land Management approved natural gas development in the Pinedale Anticline Project Area (PAPA) in 2000, but wildlife populations declined faster than predicted.
- The Bureau created a draft Environmental Impact Statement (EIS) in 2006, which analyzed three alternatives for expanding natural gas development in the PAPA.
- In 2008, the final EIS analyzed five alternative proposals for the project.
- The Bureau adopted a preferred alternative that allowed for the development of almost 4,400 wells on no more than 600 well pads.
- The Theodore Roosevelt Conservation Partnership (TRCP) filed a complaint against the Department of the Interior and the Bureau, arguing that the Bureau violated the National Environmental Policy Act (NEPA) by not including a sufficient range of alternatives.
- The court found that the Bureau followed NEPA guidelines and was not arbitrary or capricious in its decision-making.
- TRCP claimed the Bureau did not properly assess the impacts on hunting in the PAPA, but the court disagreed and upheld the Bureau's 2008 Record of Decision.
