A company won a government contract to build a radar station and subcontracted another company for road and parking area construction work. A materialman brought a lawsuit to recover for material provided to the subcontractor, but the court dismissed it saying the surety bond only benefited the prime contractor.
Issue
The issue is whether a materialman can recover under a surety bond given only for the benefit of the prime contractor, and whether the plaintiff can recover under a private bond without exhausting its remedy against the prime contractor and its surety.
Conclusion
The legal conclusion of the court is that the plaintiff can recover under the private bond provided by the subcontractor's surety.
