A trespasser must remove the encroachment and bear the full cost of doing so, regardless of how minor the encroachment.
Issue
Whether the defendants were required to tear down a wall that accidentally encroached on the plaintiff's land 1 3/8 inches, and whether the plaintiffs could be made to bear half the cost.
Conclusion
Yes and no. The defendants had committed a trespass. No matter how small the encroachment, they had no right in law or in equity to continue encroaching on the plaintiff's land. Because it was a trespass, the plaintiffs could not be required to bear any of the cost associated with tearing it down or rebuilding.

Facts
- Based on a mistaken survey of property lines, the defendant built a wall that extend 1 3/8 inches over the property line onto the plaintiff's land. Later surveys of the land revealed the mistake. The defendants offered to make it a party wall (a common wall owned by two property-owners), on the condition that the windows on the third and fourth floors remain open until the plaintiff used the wall. The plaintiff declined this offer and instead sued the defendants for trespass. The lower court ordered that defendants take down the encroaching wall, but ordered that the plaintiff split the costs with the defendant. The plaintiff appealed the cost decree.
