Although tomatoes are botanically classified as fruit, the court concluded that they are commonly considered vegetables in trade and commerce. The court relied on the ordinary meaning of the terms "fruit" and "vegetables" and took judicial notice of their meaning in the English language. The court affirmed that tomatoes are to be classified as vegetables for the purposes of trade and commerce.
