The plaintiff's land was placed in a residential district that only permits certain types of buildings, which the plaintiff argues violates the Fourteenth Amendment. The plaintiff sought a mandatory injunction to compel the city to approve their application for a building permit on the land. The court upheld the constitutionality of the zoning ordinance and dismissed the case. The plaintiff's land is surrounded by unrestricted territory, a soap factory, a railroad, and an auto factory, and cannot be practically used for residential purposes. The master found that the land would not provide an adequate return on investment and Brookline street is set to be widened, reducing the depth of the locus to 65 feet.
