Hemlock sued Sachsen for breach of a contract for the sale of polysilicon in 2012. Sachsen refused to pay the original agreed price, leading to Hemlock being awarded nearly $800 million in damages.

Conclusion
The court concluded that Hemlock was entitled to recover under the contract and that SolarWorld's affirmative defenses were unavailing. The court also concluded that the liquidated damages provision was enforceable.
