A person who finds a tree with bees in it on the property of another does not establish possession of the bees by marking the tree. In fact, in doing so, he trespassed.

Whether a person who discovers a wild animal on the land of another has a property right over the animal.
Conclusion
No. The plaintiff did not establish occupancy over the bees simply by marking the tree; in fact, he trespassed in order to mark the tree.
