The issue is: can there be a formation of battery without direct physical contact and can an employer be held accountable for their employee's harmful actions which are not directly authorized or approved by them?
Conclusion
Legal Conclusion of the Court: The conclusion is that Fisher was indeed a victim of battery even though there was no physical contact. Furthermore, the corporate defendants could be held liable for Flynn's malicious act because Flynn was working in a managerial capacity at the time of the offence.

- Fisher, a black man, was attending a luncheon at the Brass Ring Club where the club manager, Flynn, forcibly took his plate and publicly humiliated him.
- Fisher sued for assault and battery.
- A jury awarded Fisher $400 for actual damages and $500 in exemplary damages.
- However, the Court of Civil Appeals ruled out assault on the bases that there was no physical contact, or evidence of fear or apprehension.
- Amidst the dispute is whether there was actionable battery and if the corporate defendants can be held liable for Flynn's conduct.
