This case involves a plaintiff accusing David Siegrist of negligence in his duty of care towards Richard Farwell, who died due to Siegrist's negligence. The Court of Appeals reversed the verdict for the plaintiff, but the Michigan Supreme Court ruled that Siegrist breached his duty of care towards Farwell by leaving him unconscious in the back seat of his car. The court recognized a special relationship between Farwell and Siegrist, and because Siegrist could render assistance without endangering himself, he had an affirmative duty to come to Farwell's aid. The existence of a duty depends on the facts of the case, which must be proven before any standard of conduct can be set. The question of whether a duty exists is debatable and must be left to the jury to decide.
