The Supreme Court is reviewing a case where petitioners are seeking the right to marry someone of the same sex and have their marriages recognized on the same terms as opposite-sex marriages. The United States Court of Appeals for the Sixth Circuit erred in its decision by holding that states have no constitutional obligation to license or recognize same-sex marriages. The Supreme Court has recognized that same-sex couples have a fundamental right to marry under the Due Process and Equal Protection Clauses of the Fourteenth Amendment. The Court has held that marriage is a fundamental right that promotes a lifestyle and mutual loyalty, and is crucial to intimate relationships. Same-sex couples have the same right to intimate association as opposite-sex couples, and excluding them from marriage conflicts with this right. The Court has ruled that same-sex couples have the fundamental right to marry in all states, and states must recognize lawful same-sex marriages performed in other states. The Constitution prohibits states from prohibiting same-sex couples from marrying on the same terms as opposite-sex couples.
