The Supreme Court is deciding whether the National Labor Relations Act applies to lay faculty members at Catholic high schools that provide both religious and secular education. The Board ordered elections, but the schools refused to recognize the unions or engage in bargaining, leading to the unions filing unfair labor practice complaints. The Board granted summary judgment, but the Court of Appeals denied enforcement, finding that the Board's extension of jurisdiction to all church-operated schools was foreclosed by the First Amendment. The Supreme Court held that the Board's order interfered with the bishops' control of the religious mission of Catholic schools, which is protected by the First Amendment. The Court found that the Act does not clearly confer jurisdiction over teachers in church-operated schools, and the Board's resolution of charges of unfair labor practices filed against religious schools may impinge on the rights guaranteed by the Religion Clauses and involve significant entanglement with religion.
