This legal case concerns a dispute between a state and the federal government over the constitutionality of a federal law establishing a bank. The court concludes that Congress has the power to establish a bank under the Necessary and Proper Clause, which grants Congress the power to make all laws necessary and proper to carry out the government's powers. The court argues that a narrow interpretation of "necessary" in the Constitution would hinder the government's ability to carry out its objectives. The power of creating a corporation is not a substantive and independent power, but rather a means of accomplishing other objectives. Therefore, it can be considered incidental to other powers expressly given to the government if it is a direct mode of executing them. The court acknowledges that the powers of the government are limited, but the sound construction of the constitution allows the national legislature the discretion to use appropriate means to carry out its duties in the most beneficial way for the people, as long as the end is legitimate and within the scope of the constitution.
