The case involves a dispute between cotenants over the use and possession of a property. The trial court awarded a judgment in favor of the plaintiff for one-half the rental value of the properties. In the second phase, the court found that the defendant had excluded the plaintiff from using the common properties. The defendant's actions effectively prevented the plaintiff from using the land, establishing a claim for relief. The defendant argues that the damage award is excessive, but the trial court's judgment was not challenged. Each co-tenant has the right to free and unobstructed possession without liability for rents for the use and occupation of the property, as long as they do not interfere with the other cotenant's right to occupy, use, and enjoy the property.
